1. Service Description
Nano Banana ("we", "us", "our") is an AI-powered image generation platform operated by WayJet LLC. Our platform allows users to:
- Browse and purchase prompt templates created by community creators
- Generate AI images from text prompts or image references
- Upload and sell prompt templates through our creator marketplace
- Manage credits and transactions for image generation services
By accessing or using Nano Banana, you agree to be bound by these Terms of Service.
2. Account Registration & Responsibilities
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your password and account
- Promptly update your information if it changes
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent to use the service.
3. Credit System & Payments
Nano Banana operates on a credit-based system:
- Credits are purchased through our platform via Stripe (our payment processor)
- Standard image generation costs 5 credits; HD generation costs 10 credits
- Credits never expire once purchased
- Credit prices are displayed in your local currency for convenience, but all transactions are processed in USD
- All purchases are final upon completion of the transaction
Pricing for credit packages and template purchases is displayed transparently on our platform. We do not engage in hidden fees or enterprise-only pricing models.
4. Content Ownership & Licensing
Content ownership on Nano Banana follows these principles:
Your Generated Images: You retain rights to use AI-generated images created through our platform for personal and commercial purposes, subject to the limitations of applicable law regarding AI-generated content.
Prompt Templates: Creators who upload prompt templates retain ownership of their original creative work. By uploading templates, you grant Nano Banana a non-exclusive license to display, distribute, and facilitate transactions of your templates on our platform.
Purchased Templates: When you purchase a template, you receive a license to use that template for generating images. This license is personal and non-transferable.
Platform Content: All platform design, branding, and software are owned by WayJet LLC and may not be reproduced without permission.
5. Acceptable Use Policy
You agree not to use Nano Banana to:
- Generate, upload, or distribute illegal content of any kind
- Create deepfakes or non-consensual imagery of real persons
- Infringe on trademarks, copyrights, or other intellectual property rights
- Generate content depicting minors in inappropriate contexts
- Produce content that promotes violence, hatred, or discrimination
- Attempt to reverse-engineer our AI models or platform infrastructure
- Use automated tools to scrape or bulk-download content
- Engage in any activity that disrupts the platform or other users' experience
- Circumvent any technical measures we employ to enforce these terms
We reserve the right to review generated content and take action, including account suspension, for violations of this policy.
6. Creator Marketplace Terms
If you participate as a creator on Nano Banana:
Revenue Sharing: Creators receive 80% of each template sale. WayJet LLC retains 20% as a platform fee.
Template Submissions: All templates are subject to review before publication. We reserve the right to reject or remove templates that violate our guidelines.
Withdrawals: Creators can request withdrawal of their earned balance. Withdrawals are processed through our supported payment methods and are subject to minimum balance requirements.
Creator Obligations: You warrant that all templates you upload are your original work or that you have the right to distribute them. You are responsible for the accuracy of your template descriptions.
7. Refund Policy
Credits: Purchased credits are generally non-refundable, as they represent a prepaid service balance.
Exceptions: We may issue refunds or credit adjustments in cases of:
- Verified service failures where generation fails and credits are deducted
- Duplicate charges caused by system errors
- Unauthorized transactions reported within 7 days
Template Purchases: Template purchases are non-refundable as the prompt content is delivered immediately upon purchase.

8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Nano Banana is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid to us in the 12 months preceding the claim
- We are not responsible for the quality, accuracy, or appropriateness of AI-generated content
- We are not liable for third-party actions, including those of payment processors or AI service providers
9. Termination
By You: You may delete your account at any time through your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy. Unused credits are forfeited upon account deletion.
By Us: We reserve the right to suspend or terminate your account for:
- Violation of these Terms of Service
- Violation of our Acceptable Use Policy
- Fraudulent or illegal activity
- Extended inactivity (with prior notice)
Upon termination, your license to use the platform ceases immediately.
10. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes:
- We will notify registered users via email
- We will post the updated terms on this page with a new effective date
- Continued use of the platform after changes constitutes acceptance
We encourage you to review these terms periodically.
11. Governing Law & Disputes
These Terms are governed by the laws of the United States. Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration, except where prohibited by law.
